Countering Counterfeiters; Expediting Customs Process

Abstract

This article will provide new and first comprehensive analysis on the Current Interim Rule passed by Customs and Border Protection(CBP), analyzing the alternative policy, which accelerates the seizure procedure. The focus of this paper is balancing CBP’s regulatory actions in both seizure of counterfeit merchandize and the legitimate goods. The idea is to promulgate the standard in the seizure procedure accelerating the process and to cut down the number of information that is disclosed to the right holders. To implement this speedy procedure, this article provides a solution to disseminate the concern arising, by laying out a farfetched idea that helps CBP in balancing the act. This article gives an alternative solution to the long-standing concern to CBP, of the importers at the time of entry into the United States. Further on this paper reinforces the “legitimate importer” to compete with the trademark right holders in the United States by understanding their persistent concern.
