Abstract

Apologies to Professor Peter G Willoughby OBE, JP, LL.B, LL.M for a typesetting error in the answer to point 8 in the Trust Survey issue of the journal (Vol 3 No. 3, February 1997, p5) on Aldemey, concerned with the validity of exoneration clauses in trust instruments. This should have read: “As in English law: an exoneration clause that removes all liability for a trustee is inconsistent with the obligations of a trustee and therefore of no effect if the trust is to be valid”
