Abstract

The Copyright Act was amended in 1994 and one of the significant changes made in the old Act was extending protection and conferring rights to the performers by means of special rights, known as 'performers’ rights', in respect of making sound recordings or visual recordings of their live performances, and of certain related acts. The Amendment Act of 1994 harmonized provisions of the Act with the Rome Convention by providing protection to the rights of performers, producers of phonograms and broadcasting organizations. By the Amendment Act, new provisions were inserted under Sections 2(q), 2(qq), 38, 39 and 39A collectively comprising of the legislative framework pertaining to performers’ rights in India.
