Abstract

While it may be too early to fully comprehend the ramification of Uzuegbunam v. Preczewski, 592 U.S. ___ (2021), the United States Supreme Court 8–1 recent decision authored by Justice Clarence Thomas may have a profound impact on colleges and universities because students with disabilities, indeed all students, may now be entitled to sue for nominal damages even after a postsecondary institution eliminates a discriminatory policy.
