Abstract
A core reason of this study to review the Punjab Safe Cities Authority (PSCA) power of issuing “Electronic Traffic Violation Ticket” under the provisions of the Punjab Motor Vehicle Ordinance 1965. Especially under section 116-A of Punjab Motor Vehicle Ordinance 1965, with Form J of FIRST SCHEDULE of FORMS. To highlight the legal conflicts of using technology without changing the basic provisions in rule of law. This is the fact that digitalization increases the efficiency of implementing the traffic rules to offenders but there is a need for amendment in related laws and also need to provide offender a right to defend in case of wrongly charged fine. The precise review of problems and loophole, to implying the existing law upon the new provided digital solution of imposing traffic rules to the general public. The writ-petitions were filing in Lahore High Court against the jurisdiction of PSCA over issuing E-Challan without amending Law. In this study the main question was raised, prominent decrease in traffic violations after implementation of E-Challan System can justify the remaining flaws in law. The review also puts light on the significance of well-defined statutes which covers basic foundations of constitution, legislature bodies need to intact with that to amend laws according to the changing needs of modern world. In the end concludes with some recommendations regarding the relevant options to avail by the authorities to improve the effectiveness of traffic rules.
