Abstract

The article begins with a brief discussion on the origins of the English law of confidentiality, its subsequent development, and its relationship with legal professional privilege. It then turns to the application of the principles to trustees by the Jersey courts and the tension in matrimonial proceedings between orders for disclosure made by English family courts against trustees and the Jersey courts’ desire to respect the confidentiality of information relating to trusts.
