portuguesA flexibilidade da licenca compulsoria deve ser considerada como uma ferramenta real para corrigir o abuso ou desvio no uso (ou ausencia de uso) de direitos de propriedade intelectual. Este artigo examina uma das hipoteses que poderiam estar relacionadas com a licenca compulsoria reconhecida internacionalmente (mas nao utilizada) no campo das patentes relacionadas ao contexto brasileiro. A referida hipotese esta relacionada com o reconhecimento do principio da fraternidade como uma base hermeneutica para iluminar o sistema de licencas obrigatorias, a fim de se tornar mais do que apenas uma ameaca e confirmar a sua funcionalidade de concorrencia essencial. EnglishThe compulsory license flexibility should be considered as a real tool in order to correct the abuse or deviation in the use (or absence of use) of intellectual property rights. This paper looks into one of the hypothesis that could be connected with the internationally recognized (but not used) compulsory license in the patent field related to the Brazilian context. The mentioned hypothesis is connected with the recognition of the fraternity principle as a hermeneutic basis to illuminate the compulsory license system in order to become more than just a threat and confirm its essential competition functionality.
