Abstract

Public service units are organizations established by a competent state agency, political organization, or socio-political organization in accordance with the law. These organizations possess legal status and provide public administration services to serve the state management. Public service units have an important position in the process of providing public services to society, so it is necessary to have a complete legal mechanism to ensure effective operation of the unit. Currently, the legal issues related to the use rights of public service units, especially public higher education institutions, still need to be improved, leading to the inability to effectively exploit the land resources that the public service units have received. This is currently using as well as there is no preferential policy on land for public service units in order to effectively promote the nature of providing public non-business services. The article analyzes the legal provisions on public service units, focusing on public higher education institutions and the issue of financial autonomy, regulations on land of public service business units in Vietnam according to Land Law 2013, commenting on and evaluating new provisions in the revised Draft Land Law, then making a number of recommendations to improve regulations on land use rights of public higher education institutions.
