Abstract

Abstract: for more than twenty years, the private pension system has been operating in the Russian Federation. This system is based on pension contracts and pension schemes. The main participant in these relations is a private pension fund, which accumulates deposits of individuals, invests them and pays non-state (private) pensions. Other participants can be both individuals and employers in favor of their employees. It should be noted that the state exercises control over these relations. Despite the contractual nature of the relations, many issues related to non-state pension provision are overloaded with mandatory norms. Other issues, on the contrary, require State intervention in order to protect the rights of individuals. In addition, the issue of the essence of a private pension in comparison with other types of pensions provided for by the current legislation and its legal nature requires special consideration.
