Abstract

This research offers a universal test for identifying copyright conditions during the hyperlinking or content embedding in the Internet. In particular, the test allows identifying whether a permission of the copyright holder is required for a specific hyperlinking or content embedding in the Internet. The emphasis is made on the particular use/purpose of the linked digital content, which would have a decisive role in defining rights and liabilities when the digital content is communicated.
