What happens when goods subject to security interest are sold? What is the position of the innocent purchaser in relation to the secured party? The situation that the Court had to consider in Kulkarni, was where the debtor (Gwent) was in possession of the good (the car) which was subject to a security interest (a hire purchase agreement) in favour of the secured creditor (Manor Credit).
