Abstract

THE GAMBLING REVIEW REPORT WAS PUBLISHED on July 17, 2001. It had been commissioned by the Home Office but, following changes in departmental responsibilities after the General Election, was submitted to the Department of Culture, Media and Sport. The principal statute on gaming is the Gaming Act 1968 and the last review of gambling law, carried out by a Royal Commission under Lord Rothschild, was published in 1978.1 Its recommendations were never put into effect. In the intervening years, there has been a significant change in the public perception of gaming in Great Britain, from a vice to be tolerated to an acceptable adult recreation. There have also been significant technological developments, such as the development of Internet gambling, computerized gaming machines, and credit card payment systems. A comprehensive review of the modern, complex world of gaming in Great Britain was long overdue. Both the gaming industry and the Gaming Board for Great Britain had been calling for such a review for some time. From an online gaming perspective, the review is very well timed. Leading gaming jurisdictions such as the USA and Australia have been experiencing considerable difficulties in legislating online gaming. The Review Body has considered such jurisdictions during the course of its deliberations and recommended that online gaming should be permitted. Great Britain now has the opportunity, assuming the Review Body’s recommendations are implemented in the near future, to establish itself as the leading online gaming jurisdiction in the world. The report runs to some 256 pages and makes 176 recommendations relating to all forms of gambling. We have identified the most important and interesting recommendations from a gaming perspective and offer our views on their implications, if implemented, for the future of gaming in Great Britain.
