Abstract

The Centers for Medicare & Medicaid Services (CMS), along with other federal agencies announced last month that the comment period for the proposed rules for the Mental Health Parity and Addiction Equity Act has been extended from Oct. 2, 2023 to Oct. 17, 2023. The other federal agencies making the joint announcement include the Department of Treasury, Internal Revenue Service, Department of Labor and the Department of Health and Human Services. The requirements related to the proposed parity rule were published in the Aug. 3, 2023 federal register. Among other provisions, the new rule would force insurance companies to adhere to current laws stipulating that mental health care must be covered, the same as physical health care. The proposed rulemaking also proposes new regulations implementing the non‐quantitative treatment limitation comparative analyses requirements under MHPAEA, as amended by the Consolidated Appropriations Act, 2021 (see “Proposed parity federal rule aims to boost MH coverage, increase service access, MHW, Aug. 3; https://doi.org/10.1002/mhw.33729).
