Abstract
Abstract The Court of Justice of the European Union (CJEU) has recently ruled that the right to claim destruction of goods applies to all goods that infringe IP rights. The CJEU clarified that destruction may be sought not only of counterfeit goods but also of genuine goods that are placed on the European Economic Area market without the consent of the IP proprietor.
