Abstract

This chapter provides an overview of the multiple levels of polar shipping governance in place today and currently being developed. First, the global level is addressed, with a particular focus on the development of a mandatory Polar Code. Second, the chapter provides an overview of recent developments within the Antarctic Treaty System (ATS) and the Arctic Council. Third, the chapter takes a closer look at the Arctic. Most of the shipping provisions contained in the LOS Convention are of a general nature and need to be implemented through specific regulations in other international agreements. The aim of the Polar Code is in line with the guidelines, to supplement existing relevant instruments for ships operating in polar waters, whether ice-covered or not, in order to address the risks that are specific to operations in polar waters such as the environmental conditions and the remoteness of the operation.
