Abstract

The aim of this chapter to apply the legal framework governing wars of national liberation to two case studies, with the objective of analysing its efficacy and workability. This analysis highlights the problems with the legal framework itself, as well as the lack of political will that exists to apply the current legal regime to wars of national liberation. The case studies that have been chosen are wars of national liberation that have taken place in two regions in the state of Indonesian, against Indonesian rule. The first is the case of the South Moluccas and the second is the case of Aceh. In order to fully appreciate the nature of the wars of national liberation that occurred in these regions, an understanding of the history of Indonesia is first necessary.Keywords: Indonesia; wars of national liberation
