Abstract

International military missions (IMMs) are not a new phenomenon. However in recent years they have come to be deployed in increasing numbers and varying formats. The changing nature, structure and purposes of IMMs, and the diverse types of confl ict where they are deployed, raise several important legal issues. The aim of this chapter is to provide an analysis of the applicability of international rules to IMMs, with particular consideration of missions established under an International Organisation's (IO) mandate. The main issues include the identification and discussion of which rules should or could apply to IMMs under international law, in particular under International Humanitarian Law (IHL) and International Human Rights Law (IHRL). The chapter considers the complex reality of rules and practice that may apply during IMMs, with particular attention to the Capstone Doctrine.
