Abstract

This chapter provides an overview of the applicable US federal law relevant to the UCH. This includes statutes that expressly address certain Underwater Cultural Heritage (UCH). It also includes laws that were developed for heritage resources located on terrestrial land but that have been applied to UCH in the marine environment. The chapter then analyzes these laws in the context of some of the more important provisions of the UNESCO Convention on the Protection of the UCH. It also discusses the provisions of the Convention that are objected to by the US and other States who were concerned that the Convention was consistent with by the UN Law of the Sea Convention (LOSC). The chapter concludes by suggesting a way to move forward in a manner that addresses those concerns, i.e. is consistent with the LOSC.
