Abstract

This chapter discusses a frequently raised question of whether or not Kosovo presents a precedent. It is the position of the author that Kosovo is not a precedent, but, as the majority of authors agree, it will have certain impact on the future self-determination struggles and on the perception of individual states on this. In international law and relations the word precedent has a different connotation from national law. If considered from the point of view of political science it seems very difficult to consider Kosovo to be a precedent. NATO started its military intervention in the Federal Republic of Yugoslavia on humanitarian grounds without invoking any clear legal basis for it. While the Kosovo's Declaration of Independence did not create a precedent, it cannot remain without impact on the developments in other countries.
