Abstract

This is the introductory chapter of the book Environmental Sovereignty and the WTO, which focuses primarily on the World Trade Organisation (WTO) Agreement, the General Agreement on Tariffs and Trade (GATT) and the Understanding on Rules and Procedures Governing the Settlement of Disputes. Many of the arguments developed in the book may be applicable to the interpretation and application of the Agreement on Technical Barrier to Trade (TBT Agreement) and the Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement), as well, since they contain provisions that use similar or identical terms as GATT Article xx. The book clarifies the relationship between WTO law, international environmental law and general international law in order to avoid conflicts between trade liberalization and global environmental protection.
