Abstract

The Brussels I Regulation Recast has improved the efficacy of jurisdiction agreements in favour of the courts of the Member States of the European Union. It has also imported from the Hague Convention of 30 June 2005 on Choice of Court Agreements a new rule on substantive validity for jurisdiction agreements. Both reforms are welcome but raise new questions for the interpreter.
