Abstract

The article aims to demonstrate the importance of a judge’s impartiality in safeguarding a human right to a fair trial. The challenges existing in front of the judges are discussed with reference to the case law. On the other hand, presumption of impartiality established by the European Court of Human Rights is critically analysed as restricting the ability of the individuals to prove the availability of bias or prejudice on behalf of the judges.
