Abstract

The acronyms PREP, SLEP, POD, and EUA may be mysterious to the general public, but to public health officials who receive materials from the Strategic National Stockpile (SNS), the letters describe the legal foundation that gives liability protection to those who dispense and administer medical countermeasures during an emergency. The Centers for Disease Control and Prevention (CDC), which oversees the SNS, held a live webcast October 22 to address common legal questions related to the large-scale dispensing and administering of SNS materials. Such questions, said SNS Director Greg Burel, include whether local health departments are protected from legal actions if a person becomes ill from taking medications obtained from the SNS. In a point-of-dispensing (POD) setting, he asked, “if someone falls and is injured . . . is the local health department liable? If you utilize volunteers with the PODs, are they legally covered if someone should file a lawsuit related to your dispensing campaign?”
