Abstract

In 2018, a total of 1,683 new cases was brought before the Court of Justice of the European Union. In that year, the European Court of Justice and the General Court completed a total of 1,769 cases. Some of those judgments and decisions are directly relevant for Austria, some others are in some way linked to Austria and brought about substantial developments of primary and/or secondary EU law. Those developments must be observed by all Member States of the European Union. Finally, some rulings were adopted following claims or appeals brought by natural or legal persons from Austria and are therefore connected to Austria. The present contribution analyses about 40 decisions of the European Court of Justice and the General Court. In this context, the decision of the Court of Justice of the European Union is presented. Moreover, it is elaborated on the implications for the development of the EU legal order on the one hand and for the Austrian legal order on the other. The judgments and decisions were chosen from an Austrian perspective and reflect the ongoing dynamic in the case-law of the Court of Justice of the European Union, which entails an obligation of the Member States to adapt national law accordingly.
