Abstract

This comment discusses the recent English case of M (Children), Re, which involved a dispute over access between a transgender parent and her children, who were living in an ultra-orthodox Jewish community. The author argues that the trial court decision ordering no direct access was appropriate in the circumstances, despite the order's discriminatory consequences. The author suggests that Canadian law would also support the trial court's decision.
