Abstract

This case commentary examines the CAS Award in FIS v. Johaug, with particular focus on the Panel’s reasoning in relation to the notions of “No Fault or Negligence” under Article 10.4 of the WADA Code, “degree of fault” for the purposes of Article 10.5.2 of the WADA Code (“No Significant Fault or Negligence”), reliance on medical advice and the concept of delegation of anti-doping responsibility.
