Abstract

Abstract This paper assesses whether the clarity of a claim after amendments have been made to it can be challenged in a nullity suit or counterclaim for revocation before the Unified Patent Court (UPC). It argues that, given the uncertainties of Rule 30 of the UPC’s Rules of Procedure, it will be up to the Appeal Court to decide on this matter.
