Abstract

A dual convergence is under way in America, with business looking more like the professions, as evidenced by the Texas Gulf Sulphur and BarChris cases. The professional motto credat emptor—let the buyer trust—and a consequent circumscription of self-interest attach to business. Law and medicine, however, face the social control devices of business: market competition and government regulation. The Continental Vending decision, which focuses on accountants, implies, further, that professionals cannot decide privately the parameters of their practice.
