Abstract

Amicus brief on behalf of Consumers Union, the Electronic Frontier Foundation, and Public Knowledge in PHILLIPS, v. AWH CORPORATION, 415 F.3d 1303 (Fed. Cir. 2004) (en banc) (Nos. 03-1269, 03-1286), addressing principally the need to address and narrow the current “insolubly ambiguous” claim standard for indefiniteness before addressing claim construction methodology, and to avoid construing claims so as to preserve their validity.
