Abstract
State Aid provisions in European Union (EU) law are underlined by the objective of ensuring a level playing field between private undertakings competing in the internal market. To this end, the granting of subsidies from Member States is regulated not to prohibit the intervention of the state on the market, but to ensure that, when such intervention is necessary, it does not excessively distort competition. The objective of guaranteeing a level playing field is not unique to the EU internal market, but it is the transposition of one of the fundamental principles in international trade. Indeed, the rules of the World Trade Organisations regulates the granting of subsidies by signatories states to domestic companies. The protection of a level field of competition between undertakings established in the EU and UK counterparts is also one fundamental rationale that underlined the negotiation of the Trade and Cooperation Agreement (TCA) between the EU and the UK. Considering this background, this chapter will discuss the general State aid principles developed under EU law and the approach consolidated in relation to State aid in sport in the EU. In this context, the societal and well-being benefits related to sport participation, as well as the analysis of distortions in the professional sport market will be considered. This framework will then be used to assess how the TCA may affect the application of these principles in the UK and in its relationship with the EU.
