Abstract

In this article, I will propose a line of research about the theory and history of the doctrine of precedent, one of the crucial elements of the rule of law of the Anglo-American legal family. Among other things, I will show how the idea of precedent goes back to the formative period of the common law. I will also discuss the emergence of the modern doctrine of precedent as well as its relation to its medieval development.
