Abstract
The delimitation of the criminal legal rights has a great importance during the construction of the punitive state system in a specific State. Specific legal rights are chosen by different models of Law State, which are primary to reach their goals, therefore those legal rights must be satisfactorily guardianship. The historic evolution conception of legal right shows the State tendency of protecting legal rights according with the State ideology. The Criminal Law can be an important reduction source of social inequalities and of the development of the social justice in a Democratic Law State.
