Abstract

Of the seventeen states that allow commercial casinos, five require those casinos to locate on the water. Seemingly grounded in nineteenth-century riverboat nostalgia, it is time for these states to move on from these outdated water location laws. This Article provides a succinct background on riverboat gaming, including a brief survey of the laws of those states that restrict casinos to water locations. The Article then argues that riverboats pose unique dangers to the safety of people and property, are damaging to the environment, and potentially cause a loss of taxation revenue in those states that also have tribal casinos. The Article concludes by arguing that states should repeal the location laws and allow their gaming commissions to completely control the location of sites when granting operating licenses to casinos.
