Abstract
A paper on the authentic instrument as a legal institution is presented together with an review of the domestic use of the authentic instrument in the French and German legal systems. The current European Union private international law regarding the cross-border enforcement of authentic instruments is analysed together with the European Commission's reform proposals concerning authentic instruments.
