Abstract

This article is derived from a speech delivered at the New South Wales Council of Civil Liberties Berenice and Ken Buckley Memorial Dinner on 19 October 2012. The speech launched the NSW Council of Civil Liberties National Australian Security Intelligence Organisation (ASIO) Campaign to wind back ASIO's post-9/11 powers. It is argued that the powers that have been legislated for ASIO post 9/11 are excessive, unnecessary, and, in many cases, unused. In addition, these powers cumulatively pose a disturbing challenge to the Australian legal system and Australian democracy, including the rights to freedom of speech and liberty.
