Abstract

HIPAA provides for penalties on individuals who improperly disclose individually identifiable health information, but it does not provide for a private right of action for patients seeking monetary damages for HIPAA violations [1].1 Patient recourse under federal law for unauthorized access to, or use or disclosure of, protected health information is to file a complaint with the US Department of Health and Human Services Office for Civil Rights. State law, however, may provide a remedy for patients seeking compensation that is not available under HIPAA.
