Abstract
It is known that the right to property is seen as an absolute and perpetual right to the holder, however, this view has been changing gradually. So, that is simultaneously conceptual evolution in reference to the principle of the social function of property, where every owner is obliged to stick to it, otherwise, may have perished his right. Thus, the new directions of the Brazilian jurisdiction through our higher courts and also expose concepts will be presented, applications, historicity and other aspects of the property, always focused on the paradigm of its social role as a guiding principle that noncompliance is liable of rights loss.
