Abstract

This article addresses the lack of suitable procedural mechanisms to monitor the mandatory exercise of penal actions on behalf of the Prosecutor General Offices at the preliminary investigation stage of criminal proceedings. The aforementioned circumstance results in multiple important voids in our legislation that are left to the Prosecutor's discretion to resolve, thus replacing the obligatory nature of the proceedings and therefore reversing to the original procedural model in criminal prosecution.
