Abstract
The aim of this study was to evaluate the quality of herbal medicine patent wording of interest to SUS. For this, a screening of native species of the National List of Medicinal Plants of Interest to SUS (RENISUS) was performed for research and critical analysis of the writing of patent applications for herbal medicines. The study showed that of the 72 patents, 68 did not meet the novelty requirement and 63 contained no inventive step and most had inadequate description and claims; also requests brought incremental innovations; it was found that requests tended only to provide the herbal medicines, causing a negative correlation for innovative techniques; still, only 17 of the 72 patents discoursed on the prevention of any disease and did not present the risk and safety phytomedicine. The data show that open innovation can be an outlet for the accumulation of green technologies added to the product, resulting in transfer of technology to various industries, promoting socioeconomic and environmental sustainable developments.

Analysis of the technical quality of phytotherapeutic patent applications of interest to SUS. O objetivo do estudo foi avaliar a qualidade das redações de patentes de fitoterápicos de interesse ao SUS. Foi realizada uma triagem de espécies nativas da Relação Nacional de Plantas Medicinais de Interesse ao SUS (RENISUS) para pesquisa e análise crítica da redação de pedidos de patentes de fitoterápicos. O estudo demonstrou que das 72 patentes, 68 não cumpriam o requisito de novidade e 63 não continham atividade inventiva. A maioria possuía relatório descritivo e reivindicações inadequadas; ainda, os pedidos traziam inovações incrementais e não radicais; verificou-se que os pedidos tendiam apenas a disponibilizar os fitomedicamentos, ocasionando uma correlação negativa para técnicas inovadoras; ainda, apenas 17 das 72 patentes discorriam sobre a prevenção de alguma patologia e não apresentavam o risco e a segurança do fitoterápico.
