Abstract

The crime of corruption and gambling is a violation of the social rights and economic rights of the community. The crime of corruption has become an extraordinary crime. Likewise, eradication efforts can no longer be carried out in an ordinary way, but are required in an extraordinary way. What are the legal rules in non-criminal incorporation (concursus) according to the applicable legal rules? How is criminal responsibility for the perpetrators of corruption and gambling committed by the employees of PT. Bank Danamon Indonesia Region VI Medan based on the Decision No. 2759/Pid.B/2004/PN.Medan. What are the judges' legal considerations in the decision no. 2759/Pid.B/2004/PN.Medan?. The results of the study indicate that a non-criminal merger (concursus) occurs when a person commits several acts and each criminal act individually and the aforementioned acts are tried at once. Criminal liability for the perpetrators of corruption and gambling committed by the employees of PT. Bank Danamon Indonesia Region VI Medan based on the Decision No. 2759/Pid.B/2004/PN.Medan is the defendant sentenced to imprisonment for 15 (fifteen) years and with a fine of Rp. 1,000,000,000,- (one billion rupiah) with the condition that if the fine is not paid, it must be replaced with imprisonment for 6 (six) months and pay a replacement fee of Rp. 33,216,608,700,- (thirty three billion two hundred sixteen million six hundred eight thousand seven hundred rupiah) provided that if the replacement money is not paid, it must be replaced with imprisonment for 4 (four) years. The judge's legal considerations in the decision no. 2759/Pid.B/2004/PN.Medan is the judge did not find things that can release from the criminal liability either as a justification or excuse for forgiveness so that the defendant must be held accountable for his actions and found guilty of the criminal act that he was accused of so that he was sentenced.
