Abstract

The National Land Agency in resolving land ownership disputes and to determine the role of the National Land Agency on the occurrence of overlapping land ownership. The purpose of this study is to find out and reduce the occurrence of double certificates. The data collection method uses doctrinal legal research by taking a comparative approach by reviewing an existing legal material derived from binding laws and regulations. The results showed that the Role of the National Land Agency in the Settlement of Dual Certificates The National Land Agency in handling double certificate disputes has a section called the Dispute Section. In handling disputes, the National Land Agency overcomes between persons and persons, persons with institutions or subjects with subjects as owners of disputed land through litigation (court) and non-litigation (mediation). The role of the National Land Agency in resolving overlapping land ownership disputes by receiving community complaints, then collecting data and analyzing disputes, as well as reviewing and conducting field examinations. Then issue a dispute resolution decision in the form of a Right Cancellation Decision or a Certificate Cancellation Decision if it is proven that there is an administrative defect. In addition, it facilitates mediation to the parties to the dispute if the dispute allows mediation to be held.
