Abstract

In the case of blasphemy that occurred during the 2017 Jakarta Gubernatorial Election, Law No. 1/PNPS/1965 served as the legal foundation for addressing perpetrators who engaged in acts of blasphemy and according to the concept of Maslahah Al Mursalah aims to ensure that this legal decision not only meets legal requirements but also promotes the welfare of society and maintains interfaith harmony. This paper provides is to examine the regulation of blasphemy in Law No. 1/PNPS/1965 and the correlation of its application in the 2017 Jakarta Gubernatorial Election with the perspective of Maslahah Al Mursalah. The research Results of research (1) The regulation of blasphemy in the 2017 Jakarta Gubernatorial Election based on Law No. 1/PNPS/1965 lacks explicit clarity regarding the definition of blasphemy. (2) The correlation between the application of Law No. 1/PNPS/1965 in the 2017 Jakarta Gubernatorial Election and the perspective of Maslahah Al Mursalah arises in the context of security and law enforcement during the election because of cases of blasphemy. Maslahah Al Mursalah's view on the implementation of the law ensures that legal decisions not only meet legal requirements but also promote the welfare of society and maintain interfaith harmony.
