An Analysis of Investigation Results on the Manipulation Cases of Evidences Collected at the Crime Scene

Abstract

국내에서 살인사건을 위장한 유형으로는 자살, 실족사, 사고사 및 오랫동안 음식물에 독극물을 소량 섭취하게 하는 등의 사례들이 있었으나 거의 조기에 해결되는 경우가 많았다. 본 사례는 범죄현장이 잘 보존되고 매뉴얼에 의하여 현장 감식을 정밀하게 수행하였다고 하더라도 범인이 현장부재(alibi) 사실을 확보하고 무죄를 입증하고자 계획적이고 지능적으로 다른 곳에서 물적인 증거를 반입하여 인위적으로 현장을 조작하였을 가능성을 인지하지 못하고 범죄현장에 유류된 DNA시료의 감정결 과만을 신뢰하여 기초수사 등을 소홀히 함으로서 수사에 혼선을 초래하여 범인을 조기에 검거하지 못하였던 경우이다. 이 같은 시행착오의 결과는 수사가 장기화로 연결되어 많은 인력의 투입과 예산낭비가 초래될 수 있을 뿐 아니라, 영구 미제사건으로 남아있을 개연성이 크다. 국내에서 공식적으로는 사건현장을 “인위적으로 조작” 한 사례가 없는 것으로 알려져 있으나 잘못된 수사방향과 범죄행위의 은폐 의도를 차단하고 극복할 수 있었던 사례들을 소개한다.A types of murder disguised in domestic are suicide, accidently fell and died, an accidental death, and death by swallowing small amounts of poison food for a long times but be resolved at an almost early stage. Once this case, the scientific investigation agents should not completely trust what the report was written even if a crime scene is well preserved and the scene analyses are performed precisely by the manual. Because a suspect will tender evidences to prove its contention that the defendant has a sound alibi. Therefore, analytical results on faith (integrity) of crime scene that exists in specimen DNA and neglect as a basic investigation brought about much confusion in the investigation. As a result, a suspect did not trust to arrest a criminal case in an earlier phase. And the net effect is connected by a prolonged investigation and input of a large number of workers that are not only can cause a budget waste but also a high probability to remain unresolved cases of permanent. However, the cases by artificially manipulated to the crime scene are not known officially in domestic. Therefore, the primary purpose of the current case study is to introduce to cases that the investigation into the wrong directions and blocking the intended criminal act of concealment were able to overcome.
