The body of this paper is a translation of the last section (vol. 3, pp. 124–174) of a three-volume book based on lectures that Dr. Al-Sanhu r i delivered to law students in 1953-4. This version was published by Da r Ihya Al-Tura th Al- Arabi, Beirut, 1997.
