Abstract

The paper is dedicated to issues on the implementation of the Administrative and legal control over compliance with labor legislation and labor protection requirements in states of the European Union. There is stressed, the universal body which implements only control functions on labor provision, is not established in the EU; instead, as a rule, whole systems of authorities and services carry out the control in the researched field on the national level of member-states. There is outlined, the main feature of national organizational and legal systems of control over compliance with labor legislation and labor protection requirements is an interaction between the state and public sectors. It expresses in the successful and productive social dialogue. There is emphasized, the social (public, imperative) insurance against accidents at work, occupational injuries and occupational diseases are obligative components of the state labor protection system almost in all member-states. These components both provide additional confidence of employee for the future industrial force majeure and involve insurance companies in the control over compliance with labor legislation and labor protection requirements as a full-fledged supervisory institution. There is stressed, measures on improving control in the field of the compliance with labor legislation and labor protection requirements are related directly to wide implementation and practical use of risk-oriented principles; and implementation of international norms on labor protection audit as well as the best foreign practice have already led to applying risk-oriented approach in the activities of domestic controlling authorities. Despite the significant role of control functions of appropriate state institutions for qualitative provision of labor protection in the EU, preventive and educational functions of state authorities in the field of the labor protection arise. There is mentioned, these peculiarities have to become “start points” and basic principles of adaptation of Ukrainian legislation and daily practice in the field of control over compliance with labor legislation and labor protection requirements to statements and standards of the European Union.
