Abstract

Evidently, the international protection regime for those fleeing persecution is in a crisis, which this volume recognizes but does not directly address. Rather, the volume has three aims. First, to provide an understanding of what legal regime exists at the level of regional organizations to address asylum seekers. Second, to explore how regional institutions such as regional courts and national human rights commissions impact the legal protection regime, specifically how influential they are in the process of protection. Third, to recognize the important contribution of Latin America to the international protection of asylum seekers through the compendium of norms, jurisprudence and principles Latin America has produced. In seeking to accomplish these goals, the volume is structured to show that the asylum crisis stems from the interplay between law, culture and norms and that the host states use relevant laws and policies to narrow their duties often to the detriment of those seeking protection.
