Summary

Introduction

In an earlier article on provocation and the criminal law of Nigeria! I examined the provisions of Sections 3 1 8, 283, 284 and 252 of the Criminal Code of Nigeria[2] and came to the conclusion that the provocation law of Nigeria is greatly different from English law on the subject. In Galikuwa , lO the East African Court of Appeal said that in applying the defence of provocation in the witchcraft cases, the act causing death must be done in anger and that fear of immediate death is not enough .
