Abstract

The paper is concerned with the study of certain aspects of implementing European Union legal norms on the use of the wildlife objects into Ukrainian national legal system. The peculiarities of the legal concept of world are analyzed, in accordance with the current ecological legislation of Ukraine, as well as the peculiarities of the objects of the animal world, which in turn are used in the order of general and special use. It is noted that one of the special uses of wildlife is hunting, which is carried out by catching wild animals and birds that are in a state of natural freedom or kept in semi-free conditions within hunting grounds and which can be hunted. The main documents that form the policy of special use of wildlife are outlined, namely: the European Charter for Hunting and Biodiversity, Council Directive 92/43 / EEC of 21 May 1992 on the protection of natural habitats and of wild fauna and flora, № 91/477 / EEC of the Council of the EU of 18 June 1991 “On the control of the acquisition and possession of weapons”, UN Convention on Biological Diversity of 5 June 1992 № 995_030, Guidelines for Trophy Hunting 2012, Directive 2009/147 / EC of the European Parliament and of the Council of 30 November 2009 on the conservation of wild birds and others. In addition, 12 principles of hunting are considered, which are adopted in many countries of the European Union and approved by international organizations. As for Ukraine, it, as a party to the Bern Convention on the Conservation of European Wildlife and Natural Habitats, is also obliged to take these principles into account, but most of them are still not integrated into existing environmental legislation, and, accordingly, are not implemented in Ukraine. A detailed analysis of the legislative consolidation of hunting management, both in Ukraine and in some European Union countries (Poland, Slovakia, Hungary), significant differences that were identified in the analysis, and which should be taken into account when bringing the current national legislation in this area, to the legislation of the European Union, are given in the form of a table. A number of suggestions on the implementation of EU legal norms in Ukrainian legislative framework have been provided in the conclusions of the paper on the legal regulation of hunting management.
