Abstract

AbstractPurpose: The Scientific article is devoted to the study of actual problems of the development of the legal mechanism for ensuring national security of the Russian Federation.Design/Methodology/Approach: When carrying out scientific research, the authors used various methods, including such General scientific methods as system-structural and sociological, as well as special methods that can include comparative legal, historical-legal, structural-functional, formal-legal. In particular, using the system-structural method of scientific research, the authors analyzed the basic terms and categories related to the study of the problem, taking into account the totality and interrelation of elements of the legal mechanism for ensuring national security of the Russian Federation. The sociological method allowed the authors to trace the actual effectiveness of the legal mechanism established by the norms of Russian legislation to ensure Russia's national security. The comparative legal method was applied when comparing the structural components of the legal mechanism for guaranteeing the national security of the country as a result, the positive and negative aspects of the object under study were identified and the proposed and most optimal directions for improving Russian legislation were identified.Findings: The author's view on the definition of national security is Formulated and the development of the constitutional doctrine of national security is updated, its goals, tasks and content are justified. The scientific novelty of the research is determined by the statement itself and the proposed ways to solve the scientific and practical problems caused by it to date, such comprehensive research on constitutional and legal issues of ensuring national security of the Russian Federation has not been carried out properly in the Russian Federation. The developed proposals for improving the system of constitutional and legal mechanism for ensuring the national security of a modern state represent a new promising scientific direction.Originality/Value: The Theoretical significance of the research is determined by the comprehensive development of scientific bases for the study of the processes of determining and disclosing the essence, content, and structure of the constitutional and legal mechanism for ensuring national security of the Russian Federation.
