Abstract

In this piece, the author argues that the UN's Committee Against Torture abused its authority when it called the Holy See (the Vatican) and suggested that individual cases of rape or sex abuse by Catholic priests constituted torture under the Convention Against Torture. The author uses traditional criminal law analysis, defendants' rights, and international law precedent to show that the Committee Against Torture's reading is improper.
